Prenuptial Agreement — Notarial Certification

A prenuptial agreement is an agreement between partners about to marry, regulating the division of property in case of divorce or death. Under Section 2(g1) of the Financial Relations Between Spouses Law, 1973 (חוק יחסי ממון בין בני זוג, תשל״ג-1973), a financial agreement can be certified by a notary — no court required. This is the fastest, simplest, and most cost-effective way.

What is a prenuptial agreement?

A prenuptial agreement is a binding legal agreement between spouses that defines how property will be divided between them. The agreement can stipulate that assets owned before the marriage remain with their owner, set arrangements for a shared home, business, savings, inheritances, and more. Notarial certification under Section 2(g1) gives it full legal validity — equivalent to court approval.

When do you need a prenuptial agreement?

  • Couples where one or both bring significant assets to the marriage
  • When there's a business to protect
  • Second marriage — protecting children from the first marriage

  • Couples wanting certainty and peace of mind

  • Couples from different cultures with different expectations

Frequently Asked Questions

How much does a prenuptial agreement cost?

446 ₪ (base) + 74 ₪ per additional copy. Before VAT (18%). Uniform tariff across all notaries.

Do we both need to come?

Yes. A financial agreement requires physical presence of both partners — the notary must verify free consent of both.

Is notarial certification equal to court approval?

Yes. Under Section 2(g1) of the Financial Relations Law — notarial certification equals court approval. No need to go to court.

Can we modify the agreement later?

Yes. With both parties' consent, a new agreement can be made to replace the previous one.

What happens without a prenup?

Without an agreement — resource equalization under the Financial Relations Law applies. All assets accumulated during the marriage are split equally.

Is an agreement signed on the wedding day valid?

Technically yes, but a court may invalidate it claiming duress. It's recommended to sign well before the wedding.

How long does it take?

About 45-60 minutes at the office. Preparing the draft in advance streamlines the process.
