A postnuptial agreement is an agreement between married spouses regulating the division of property between them. Like a prenuptial agreement, a postnuptial agreement can also be certified by a notary under Section 2(g1) of the Financial Relations Between Spouses Law, 1973 — no court required.

What is a postnuptial agreement?

A postnuptial agreement is a binding legal agreement signed by spouses who are already married. It defines property division, housing rights, savings, and assets. Under Section 2(g1) of the Financial Relations Between Spouses Law, 1973 (חוק יחסי ממון בין בני זוג, תשל״ג-1973), it can be certified by a notary — giving it the same validity as court approval. Both spouses must be present.

Yes, if the parties specified so in the agreement. Inheritances can be excluded from resource equalization.
