A notarial power of attorney for mortgage is a document required by the bank as part of the mortgage application process. The POA authorizes the bank (or the bank's lawyer) to register a lien (mortgage) on the property at the Land Registry, and in case of default — to act to realize the property. The document must be authenticated by a licensed notary.
What is a POA for mortgage?
A mortgage POA is a notarial document under the Notaries Law, 1976 (חוק הנוטריונים, תשל״ו-1976), in which the borrower (property owner) authorizes the bank to register a mortgage on the property at the Land Registry (Tabu). The POA is irrevocable and gives the bank the right to act with the Land Registry. The notary verifies the borrower appears in person, identifies properly, and understands the document's implications.
