A mutual will is a will in which two spouses bequeath in each other's favor. Typically, each spouse leaves their assets to the other, and after both pass away, the assets transfer to children or other designated heirs. A notarized mutual will under Section 22 of the Inheritance Law provides maximum legal certainty and makes contesting extremely difficult.

A mutual will is a document in which two spouses make interdependent wills — each relies on the other's will. It is made before a licensed notary under the Notaries Law, 1976 and Section 22 of the Inheritance Law, 1965. Both spouses must be present. The notary ensures each understands the content and acts freely. Revoking a mutual will requires notifying the other spouse.
